| Both parents are legally obliged to support their child according to their ability to do so. Most jurisdictions have set child maintenance guidelines, which provide a formula for determining child support grounded upon a proportion of each parent's gross income. Such issues are seldom a concern for the court during a committed relationship. But when parents separate or live separately from their children, the court normally obliges a non-custodial parent to pay child support to a custodial parent. This issue can be settled by agreement or by arguing over it in the courtroom. Like alimony, child maintenance payments, may be included into the divorce judgment or may be determined in a marital separation agreement. This contested issue can be avoided, provided both the mother and the father decide on the appropriate sum of child support and make it part of a marital separation agreement. If a non-custodial parent has other legal responsibilities, they will also be considered in deciding on child maintenance. For example, if the non-custodial parent is paying child support from a previous relationship, it will be taken into consideration. Living expenses, such as rent and food will also be considered by the court. However, the court will not decrease child maintenance payments to make it easier for the non-custodial parent to make discretionary payments. For instance, a parent cannot donate money or buy a high-priced car at the expense of financially supporting his or her own children. Unlike alimony, child support payments cannot be deducted from the parent's income taxes. To assist the court in determining the appropriate sum of child maintenance, both parents are to prepare a financial declaration. Each parent will be required to provide full information on their income, property holdings, including checking accounts, investments and real property and their financial obligations. The court will rely heavily on these documents in making the order and, hence, it is in the children's best interests that the declarations be completed completely and honestly. Parents who refuse to pay child support will be punished. If the custodial parent files a complaint to the district attorney's office, the nonpaying parent can be taken to court In the USA if the nonpaying parent is found guilty, he or she may be imprisoned. Or, the guilty parent may be put on probation and allowed to stay free if he or she repays all child maintenance and makes all future payments in a timely manner. |
